CIVIL RENTALS owns and operates this Website. This document governs your relationship with CIVIL RENTALS. Access to and use of this Website and the products and services available through this Website (collectively, the “Services”) are subject to the following terms, policies, rules, conditions, disclaimers, and notices (the “Terms”). By using the Services, you are agreeing to all of the Terms of Service, as may be updated by us from time to time. You should check this page regularly to take notice of any changes we may have made to the Terms of Service.
This Site may contain links to other websites (the “Linked Sites”), which are not operated by CIVIL RENTALS. CIVIL RENTALS has no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of them. Your use of the Linked Sites will be subject to the terms of use and service contained within each such site. Additionally, the Site contain individual listings made by users of the Platform to rent out or seek to rent equipment. The listings are merely facilitated by CIVIL RENTALS and CIVIL RENTALS is not responsible for the accuracy of any information contained within a listing. It is the responsibility of each user to independently verify the truth or accuracy of information contained in a listing.
You must not misuse this Site or Platform. You agree that you will always use the CIVIL RENTALS Site, Services, and Platform in accordance with these Terms and not for any improper or illegal purpose. You agree to use the listings, rentals, and equipment facilitated by the Site in compliance with all laws, regulations, and ordinances that may be applicable. You will not: commit or encourage a criminal offense; transmit or distribute a virus, trojan, worm, logic bomb or any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene; hack into any aspect of the Service; corrupt data; cause annoyance to other users; infringe upon the rights of any other person's proprietary rights; send any unsolicited advertising or promotional material, commonly referred to as “spam”; or attempt to affect the performance or functionality of any computer facilities of or accessed through this Website. Breaching this provision would constitute a criminal offense and CIVIL RENTALS will report any such breach to the relevant law enforcement authorities and disclose your identity to them. See Improper Use of the Platform or Services for more details. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it. Certain Third Party Providers impose additional terms and conditions of use set forth elsewhere herein. Your use of Content from those Third Party Providers is also subject to those terms and conditions of use and you forever hold CIVIL RENTALS harmless from any and all claims, obligations, and/or liability arising in connection with the use of any Content, materials and information provided by any Third Party Provider.
In addition to the above restrictions, it is improper for any user of the Site, Platform, or any person who uses the equipment sharing Services provided by others, to engage in any of the following conduct, on the Site, Platform, or in person while renting out or renting equipment listed on the Platform (collectively “use”):
The Offer should be legally in a position to offer the Contracts and outsource the jobs under the Contract and should not be prohibited either by any applicable law or as per the terms of any contract or by any other restriction from offering such Contract. Wherever required, the Offer should ensure to procure necessary permissions, licenses, clearances including any government clearance, clearance from any authority including clearances for land, environmental, site preparation etc. as may be applicable or required. The Offer should set out the payment terms and dispute resolution mechanisms clearly on the Website while offering the Contract. Any tax implications/ liabilities with respect to the Contract should be clearly specified.
Upon agreement of a price, both Owners and Renters are required to execute a rental agreement (“Rental Agreement”) by following the instructions at checkout. You agree to sign the agreement electronically or by checking a box indicating your agreement with the Rental Agreement. The Rental Agreement will contain the price, dates, delivery time and method, return time and method, and any special instructions. You agree that the Rental Agreement is a contract purely between you and the other party (Owner or Renter) and that CIVIL RENTALS is NOT a party to the Rental Agreement. The language and delivery of the Rental Agreement is provided by the Platform purely for convenience and does not create an obligation or right of CIVIL RENTALS or create any liability or participation in the transaction. By providing the rental Agreement, CIVIL RENTALS is not providing any legal advice but is merely facilitating the transaction with standardized forms.
It is the responsibility of the Owner and the Renter to coordinate together to avoid damages to the equipment. Owners should keep good track of damages, dings, wear and tear, and other visible instances of damage and the condition of their equipment. Renters should visually inspect the equipment and return to ensure that Renters are not blamed for any damage that they did not incur. BOTH PARTIES SHOULD VISUALLY DOCUMENT THE CONDITION OF ALL EQUIPMENT VIA PHOTOGRAPHS TAKEN AT DELIVERY. CIVIL RENTALS cannot and will not mediate disputes between users if there is no photographic record clearly showing the condition of the equipment before and after the alleged damage occurred. Many of the pieces of equipment rented are to be used in rugged environments and wear and tear, including visual wear and tear, is to be expected. In such instances, Owners should limit claims for situations that they in good faith believe to be beyond normal wear and tear of equipment being used as intended in working and rugged environments. In instances where the equipment is sensitive or Users are especially concerned about damage, users should obtain appropriate insurance policies covering all concerned damage areas.
The Bidding / RA module of CIVIL RENTALS is a tool provided to the Customer who need equipment(s) on rent for organizing bidding CIVIL RENTALS Sellers of the particular equipment category for a pre-defined requirement i.e. quantity, technical parameters for equipment of the particular product category required for one or more Customer who need equipment(s). Prior to initiating Bidding, the Customer who need equipment(s) shall judiciously search and shortlist item among the items offered on CIVIL RENTALS using filters such as quantity, technical parameters, consignee location(s) etc. as per the requirement. In case the search made using actual quantity required, fails to identify sufficient offers, the Customer who need equipment(s) may use an indicative quantity for initial search and selection of product and quantity may be amended to match the actual requirement at the time of finalizing Bidding. The technical parameters and documents of the item identified by the Buyer shall be base parameters of the item for conducting Bidding for the required equipment’s. On other hand equipment owner can participate in bidding who received invitation from customer and accepting invitation. The lowest bidder will be selected as per the requirement of customer needs. They will receive call from customer side after finalizing the bidding deal. The CIVIL RENTAL will not involve in between the deal at meeting point.
No delay or failure to take action under these Terms shall constitute any waiver by CIVIL RENTALS of any provision of these Terms. If any provision of these Terms is invalid or unenforceable under applicable law, it is, to that extent, deemed enforceable to the fullest extent possible (and severable in the event such provision is completely unenforceable) and the remaining provisions of these Terms will continue in full force and effect. These Terms will bind and inure to the benefit of CIVIL RENTALS permitted successors and assigns. Any claim under these Terms must be brought after the cause of action arises. These Terms are personal to you and may not be transferred, assigned or delegated to anyone. Any attempt by you to assign, transfer or delegate these Terms shall be null and void. CIVIL RENTALS may freely assign these Terms without consent or notice. These Terms (including all documents expressly incorporated herein by reference, including but not limited to the Privacy Policy and Rental Agreement) constitute the complete and exclusive agreement between CIVIL RENTALS and you with respect to the subject matter hereof and supersede all prior oral or written understandings, communications or agreements not specifically incorporated herein.

CIVIL RENTALS Refer and Earn is a referral program open to only registered Users on the CIVIL RENTALS. Credit in the form of Cash is earned by the User when the Referred User successfully signs up and purchased any subscription plan on CIVIL RENTALS Website for the first time. Rewards will be automatically credited in the form of Cash in the wallet attached to the account of the User on CIVIL RENTALS website.
During the Rental Period, Customer shall maintain, at its’ own expense, the following minimum insurance coverage.
General liability insurance. Property insurance against loss by all risks to the Equipment, in an amount. Worker’s compensation insurance as required by law; and if the Equipment is to be used on any roadway, automobile liability and physical damage insurance (including comprehensive and collision coverage, a non-owned vehicle and endorsement and uninsured motorist coverage), Such policies shall be primary (and not on an excess basis), on an occurrence basis. Customer shall provide certificates of insurance evidencing the coverage’s required above prior to any rental and any time (failure to provide such certificates may constitute a breach of this Contract). The insurance required herein does not relieve Customer of any of Customer’s responsibilities, indemnification or other obligations herein, or for which customer may be liable by law or otherwise.
These Terms shall be governed by and interpreted and construed in accordance with the substantive laws of India, without regard to the conflict of law’s provisions thereof. The courts in Maharashtra shall have exclusive jurisdiction on all matters pertaining to this Agreement. User must not aid or encourage the filing of any third-party claim or lawsuit against CIVIL RENTALS, and User must cooperate fully with CIVIL RENTALS and CIVIL RENTALS insurer in the investigation and defence of any claim or lawsuit. The Hirer alone will be responsible for obtaining any necessary permissions and consents for the erection and operation of the equipment and for compliance with all regulations issued by the Government, Municipality or local authorities and the Owner shall not be responsible for any breach thereof. Any fines incurred due to the Hirer’s negligence during delivery or installation & transportation of equipment(s) is/are the responsibility of the Hirer.
CIVIL RENTALS captures, stores, processes and uses the Customer’s personal data, including, but not limited to, the usage and vehicle data as they relate to the Customer, to the extent this is necessary for the administration and implementation of this Agreement and the Customer’s use of the CIVIL RENTALS.
Should third-party services be used, CIVIL RENTALS is entitled to forward to the third-party service provider the Customer’s personal data, to the extent this is required in order to fulfil customer ship or use requirements. CIVIL RENTALS is entitled to provide Customer’s personal data to third-parties for the purposes of providing individualized offers, services, and other customized information to Customers.
CIVIL RENTALS shall implement and maintain reasonable procedures for protecting sensitive personal information in compliance with applicable law.
CIVIL RENTALS shall be entitled to disclose information of the User to CIVIL RENTALS parent company and to all companies controlled by CIVIL RENTALS or any of its affiliates and to any government body as required by the law/ or by directive/ or request from any government body or to any third party deemed fit and proper by CIVIL RENTALS, in its absolute discretion.
